1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and TechPulse Media Group LLC ("TechPulse", "we", "us") governing your access to and use of the website at techpulsemag.com (the "Site") and all associated content, features, and services (collectively, the "Service").

By accessing the Site, clicking "Accept", subscribing to our newsletter, or otherwise using our services, you confirm that you are at least 13 years old (or 16 years old if you are located in the European Economic Area), that you have read and understood these Terms, and that you agree to be bound by them.

TechPulse is an online technology and science news publication providing articles, analysis, reviews, and commentary on topics including artificial intelligence, space exploration, quantum computing, biotechnology, and consumer electronics.

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Permitted Use

Subject to these Terms, TechPulse grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial informational purposes.

You may:

  • Read, view, and access published articles and content for personal use.
  • Share links to TechPulse articles on social media or via email.
  • Print or save single copies of articles for personal, non-commercial use.
  • Subscribe to and receive our newsletter.

4. Prohibited Conduct

You agree that you will not:

  • Reproduce, republish, distribute, sell, or exploit any portion of the Site's content for commercial purposes without prior written permission from TechPulse.
  • Scrape, crawl, or use automated tools to access the Site in a manner that exceeds normal browsing activity, or in a way that places an unreasonable burden on our infrastructure.

  • Introduce viruses, malware, or other harmful code to the Site.

  • Remove, obscure, or alter any copyright notices, trademarks, or other proprietary rights notices on the Site.
  • Impersonate TechPulse, its staff, or any other person, or misrepresent your affiliation with any entity.
  • Use the Site in any manner that violates applicable law, regulation, or these Terms.

5. Intellectual Property

All content on the Site — including but not limited to articles, text, photographs, graphics, logos, icons, audio clips, digital downloads, data compilations, and software — is the property of TechPulse Media Group LLC or its content suppliers and is protected by United States and international intellectual property laws.

The TechPulse name, logo, and associated trademarks are registered or unregistered trademarks of TechPulse Media Group LLC. You may not use our trademarks without our prior written consent.

Limited excerpts of our content (up to 150 words per article) may be quoted for editorial, critical, or educational purposes provided full and clear credit is given to TechPulse with an appropriate link back to the original article.

6. User Content

If you submit content to TechPulse (such as comments, letters, or story tips), you grant us a worldwide, royalty-free, non-exclusive, perpetual licence to use, reproduce, modify, publish, translate, and distribute such content in any media, in whole or in part, and to incorporate it into other works.

You represent and warrant that you own or have the necessary rights in any content you submit, and that it does not infringe the rights of any third party or violate any applicable law. TechPulse reserves the right (but has no obligation) to review, edit, or remove user-submitted content at our sole discretion.

Our Site may contain links to third-party websites, services, or resources. These links are provided for your convenience and information. TechPulse does not endorse and is not responsible for the content, privacy practices, or availability of any linked third-party sites. Your use of third-party sites is at your own risk and is subject to the terms and conditions of those sites.

8. Advertising

TechPulse is an advertising-supported publication. Advertisements, including those served by the Meta Audience Network and other third-party ad networks, may be displayed on the Site. Advertisements are clearly distinguished from editorial content. TechPulse does not endorse the products or services featured in advertisements and is not responsible for the accuracy of advertising claims.

TechPulse does not warrant that: (a) the Service will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL TECHPULSE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, OR SYSTEM FAILURE — ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF TECHPULSE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNT YOU PAID TO TECHPULSE IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow limitation of certain warranties or damages, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless TechPulse, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) any content you submit to TechPulse; or (d) your violation of any third-party rights.

12. Termination

TechPulse may, at its sole discretion, terminate or suspend your access to all or part of the Service immediately, without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Service ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. You irrevocably consent to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California, for the resolution of any dispute arising from these Terms.

If you are a consumer located in the EU or UK, you may also have the right to bring proceedings in the courts of your country of residence.

14. Dispute Resolution

Before initiating any legal action, you agree to first contact us at hello@techpulsemag.com and attempt to resolve the dispute informally. If we cannot resolve the dispute within 30 days, either party may pursue formal legal remedies.

For non-US residents, nothing in these Terms limits your right to bring claims under applicable mandatory consumer protection laws in your jurisdiction.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date at the top of this page. Where required by law, we may also notify newsletter subscribers by email. Your continued use of the Service after the effective date of updated Terms constitutes acceptance.
